1)The motor vehicles (Cars and Scooters) available at Paradise Garage and any other rentals (Stroller, Booster and pushchair) are solely to be used for the purpose of social, domestic and pleasure activities or business purposes within the Maltese archipelago.

2) The vehicles provided are in good mechanical condition and thus, it is imperative that the vehicles rented must be returned in tale-quale (Same state and condition) except from normal wear and tear at the termination of hire.

 

3) The Individual who is using our rental services must inform Paradise Garage of any loss or damage/s to, or fault/s in the vehicle or rental. Use of the vehicle or rental when damaged or faulty shall be at the Person’s responsibility/risk who is using our rental. Unauthorized repairs are not allowed, and if such repairs are done, the Person who is using our rental services shall be responsible for any faults/issues or damages caused as a result.

4) Any Individual who is using our vehicle hire services will be responsible for the normal insurance excess amount of €400 with reference to any claims that could arise. This amount may only be waived if the driver is willing to pay an extra charge per day (Prices vary according to season and type of vehicle).

5) All motor vehicles are provided with fully comprehensive insurance. If any of our vehicles are driven against the terms of either this agreement or the insurance policy whilst being used by the Person using our services, the Individual who is using our rental services shall be liable for the payment of all damages.

6) The Person who is using our vehicle hire services declares/agrees that he/she has examined the insurance policy regarding the vehicle, accepts the terms, and accepts that he/she is aware of his/her rights and responsibilities under the said insurance policy that these have been explained to him/her.

​

8) The Individual who is using our vehicle hire services is responsible to delegate and replace to Paradise Garage in any right or remedies for the scope of enforcing such rights and remedies or to obtain relief or reimbursement from third parties in relation of any loss or damage to or in reference with their agreement within the time the rental is being used.

 

9) Paradise Garage shall not be responsible for any loss of or damage to any loss of property, stored property or transported property in the vehicle by the Person who is using our rental services. The Person who is using our rental services will be responsible for all risks during the duration of the agreement and yields all claims against Paradise Garage.

 

10 Paradise Garage may at any time reposses himself of the vehicle without giving notice to the Person who is using our rental services provided there is a justified reason. Paradise Garage’s rights under this agreement may only be waived when a written instrument duly signed by Paradise Garage of his accredited representative is presented.

 

11) The Person who is using our vehicle hire services accepts to pay any fines for traffic violations or road contraventions. The Individual who is using our rental services will also be responsible for any associated fees incurred for recovery of a towed vehicle due to law violation. The Person who is using our vehicle hire services grants permission to Paradise Garage to charge them to his/her credit card account (Including in his absence) along with any administration charges. However such fees may instead be settled on the spot in cash. Receipts will also be provided.

 

12) Paradise Garage does not accept any responsibility for delays as a consequence of breakdowns or similar occurrences.

13) Any tyre damages, including punctures are the Hiree’s (Person who is using our rental services) liability and as such shall be paid by the Person who is using our rental services.

​

14) A €20 fee will be charged per repair on site and tows if the fault is at the negligence of the Person using our vehicle hire services (E.G. Accidents, punctures, careless parking and careless driving).

​

15) The Individual who is using our vehicle hire services will be charged accordingly on a minimum of a 24hours basis. This can only be waived if the car keys are left at our premises at the agreed date, time and place. If the Person who is using our vehicle hire services does not do so (Leave the car keys at the agreed date, time and place), then it will be implied that the Hiree (Person using the vehicle for hire) intends to extend the Hire of his/her rental.

 

16) Paradise Garage cannot warrant the automatic extension of any rental agreement and reserves the right to claim back the rental from the Individual who is using our vehicle hire services in the case of an unauthorized rental extension.

 

17) A fee of €50 will be charged where applicable if the vehicle is returned excessively/unusually dirty (E.G. pet hair, spilled food/drink, excessive litter, stickers on windows, the presence of bodily fluids, etc)

18) The Individual who is using our vehicle hire services agrees to and is responsible not to drive the vehicle at excessive speeds which go above the local Maltese laws. Using our vehicles for off-roading is not permitted.

 

19) The Person who is using our rental services agrees and must not drive the vehicle through excessive levels of water. The Individual who is using our vehicle hire services will be responsible for any costs and damages induced by non-conforming to these related terms.

 

20) The Person who is using our vehicle hire services agrees to never leave the vehicle before removing the key from the ignition, locking the car and putting on the anti-theft device where applicable. The Person who is using our rental services will be responsible for any costs and damages which result by non-conforming to these related terms.

 

21) The Individual who is using our vehicle hire services also accepts/agrees that the vehicle shall not be utilised by or for the following non permissible purposes:

a) By a diver who is not authorized to use the vehicle.

b) By any driver known or alleged to be under the affect of alcohol, drugs, or anything else known to cause driving imparity (Dangerous driving).

c) For any unlawful purpose (In respect to Local Maltese Laws)

d) In any abusive or careless manner

e) To transport Persons or items/property for rental

f) To push or tow anything

g) For any race, competition or training activity

 

22) The Person who is using our vehicle hire services acknowledges that:

The Individual who is using our rental services does not suffer from any mental or physical disability that would impair driving ability, including hearing or sight deficiencies not being correctly addressed by special equipment that would render such deficiency irrelevant to driving ability.

b) The Person who is using our vehicle hire services has not been convicted due to any pending criminal proceedings during the past 5 years.

c) The Individual using our vehicle hire services is of 21 years and older.

d) The Person who is using our car rental services has currently a license free from any endorsement.

 

23) In the occurrence that any of the above clauses/conditions are not adhered to, the Person who is using our vehicle hire services grants permission to Paradise Garage to charge the credit card account being used during the vehicle hire service (Including during the absence of the Hiree - the Person who is using our rental services) with any costs that Paradise Garage has undertaken due to these measures.
